Lakota Sky Service Contract
1. Services
The Service Provider shall provide the following services to the Client (the "Services"):
They vary on the service level, from Platinum, Gold, Silver, and Premier Fishing. All membership services are subject to the availability of animals, fish and weather conditions, or any unforeseen events. The Platinum membership includes but is not limited to harvesting one big game animal decided upon by the Lakota Sky guide, environmental conditions, limitations of hunting tags, seven days of lodging, including meals, and the option of fishing included. Additional guests of up to four people for lodging are included. However, hunting and fishing fees will apply. Gold Membership includes but is not limited to harvesting one big game animal decided upon by the Lakota Sky guide, environmental conditions, and limitations of hunting tags. It also includes five days of lodging, including meals, and the fishing option included. Additional guests of up to one additional person for lodging are included. However, hunting and fishing fees will apply. Silver Membership includes but is not limited to the harvesting of one female big game animal, decided upon by the Lakota Sky guide, environmental conditions, and limitations of hunting tags. It also includes two days of lodging, including meals. Premier Fishing membership consists of five days of guided fishing and five days of lodging with meals. All membership levels are subject to and can change due to weather, unforeseen environmental factors, and Laktoa Sky guides jurisdiction.
2. Payment
The Client shall pay the Service Provider the total amount for the membership Services. For the Platinum membership, $25,000. The Gold membership is $13,000. The Silver membership is $6,000. The Premier Fishing membership is $5,000. Payment shall be made online or through a check for the total amount of the membership fee.
3. Confidentiality and Intellectual Property
The Service Provider acknowledges that it may have access to confidential information of the Client. The Service Provider agrees to maintain the confidentiality of all such information and not to disclose such information to any third party.
Any intellectual property created by the Service Provider in the course of providing the Services shall be the Client's property.
4. Termination
Either party may terminate this Contract upon 30 days written notice to the other party.
5. Liability
The Service Provider shall not be liable for any damages or losses incurred by the Client as a result of the Services, except to the extent caused by the gross negligence or willful misconduct of the Service Provider.
